We have important news regarding the progress of our legal actions against Unibet. In this update, we will tell you more about the summary proceedings that Gokverliesterug has initiated on behalf of 23 participants.
De Telegraaf, Nu.nl, and CasinoNieuws.nl have already published about our summary proceedings against Unibet.
Why summary proceedings against Unibet? Unibet has recently started refusing to provide personal data to consumers who request it. This is in violation of the privacy law (GDPR). This data is essential to demonstrate the net loss of our participants. Without this information, it becomes difficult or even impossible to claim repayment. Therefore, Gokverliesterug has initiated summary proceedings at the Amsterdam district court to compel Unibet to comply with the data access requests.
What is the goal of this lawsuit? We have deliberately chosen to conduct this summary proceeding on behalf of a smaller group of claimants. This keeps the case straightforward and allows the judge to make a decision more quickly. Our goal is for Unibet to eventually provide the requested data to all participants, as they have done in the past.
What does this mean for you as a participant (or interested party)? If this summary proceeding is successful, the judge will determine that Unibet is obligated to provide the gaming and transaction history. This is crucial information for demonstrating your net loss. Why is Unibet no longer responding to data access requests? Until recently, Unibet did provide access. But after several Dutch courts ruled that agreements with illegal online casinos are void, Unibet suddenly stopped cooperating. This data is the evidence consumers need to claim their net loss. By withholding this information, Unibet is trying to buy time and prevent having to repay.
What is Gokverliesterug doing in the meantime? We are busy preparing the collective lawsuit. At the same time, we are increasing legal pressure, as we are doing now with these summary proceedings. We have also previously filed complaints with the Dutch Data Protection Authority and the Gambling Authority. We will not stop until Unibet takes responsibility.
When is the hearing? The hearing in the summary proceeding will take place on May 26, 2025. The ruling will follow a few weeks later. Of course, we will keep you informed of developments.
